The UK is a highly desirable place for immigrants looking to live and work overseas. Any foreign national that wants undertake employment in the UK requires a work permit. There are a number of ways to obtain a UK work permit, depending on your skills and qualifications.

If you are highly skilled or have a professional qualification, you can apply for the Highly Skilled Migrant Program (HSMP). If apply for the HSMP and are successful, you will be granted access to stay in the UK for 2 years. If, after those 2 years, you’d like to stay for longer, you will have to prove that you are in permanent, full time employment.

If you have been offered a job in the UK, your potential employer can apply for a work permit on your behalf. The employer will have to prove that you have enough experience to be granted a work permit, and they will have to prove that they have made satisfactory efforts to hire a UK or EU citizen. If you are successful in gaining a permit this way, remember that it is only specific to the employer who applied for it. If you want to work somewhere else, you will have to apply for another work permit.

If you able to be successfully granted indefinite leave to remain in the UK, you will not have to apply for a work permit. In order to be eligible for indefinite leave to remain, you need to have been living and working in the UK for 5 years.

The process of applying for indefinite leave to remain from inside the UK will vary depending on individual circumstances. Applying for ILR is usually dependent on how many years you have lived in the UK, although rules can differ for those who have a spouse who is a British Citizen or who already has ILR.

Applying from within the UK requires the completion of a settlement application form, and you need to get the right form for your circumstances or current immigration status. Our team of immigration solicitors can help by advising you which form you need. Before spending the time and money on the application process, however, it is important to establish whether you have a good case, which is where we come in.

The usual requirements for being granted ILR are that you have had a settled status in the UK – that you have been here on the same visa class for a minimum of four years. Student visas don’t count as part of this, however, and marriage visas only require two years residency, so you will still need to check your individual circumstances before applying.

Most applicants will also need to demonstrate their knowledge of language and life in the UK, although again there are some exemptions, of which we can advise you further. If you are not exempt, you will need to demonstrate this knowledge by either passing the ‘Life in the UK’ test or by taking and passing a course in English language and citizenship.

Accessing the best information regarding immigration can be a very difficult and time consuming process. Many people who wish to remain or live in the UK legitimately might have to seek an immigration solicitors so that they can make a reasonable application to the Home Office. This will help applicants on a number of levels since they will be accessing some of the best information in the industry regarding immigration. All solicitors are required to be experts in their field, and immigration is no different. Despite its complexity, an immigration solicitor should be able to listen to a particular case and a client’s situation, and then be able to suggest the best way of proceeding.

All people who are applying to live in the UK will do so through the Tier system which assigns points to each individual. Tier 1 individuals are those highly skilled workers who are also highly desirable. A country can often be very welcoming of this type of worker who may be of the stature of a doctor or a surgeon. The United Kingdom, like many other countries, wants to attract entrepreneurs and investors, so it helps if an applicant is going to bring something significant along with their UK work permit. Those students who are at advanced stages of their studies are also generally welcomed.

Immigration solicitors like this can offer assistance regardless of what Tier a client falls into. They can often also offer expert advice for those who wish to seek asylum in the UK.

If you have escaped a terrible situation in your home country and have started to make a life for yourself in the UK, then the last thing you want is the constant worry over when you might be made to leave because your visa has run out. Gaining indefinite leave to remain status means that there would no longer be a time limit on your stay in the UK, although you shouldn’t leave the country for periods of longer than two years.

Another benefit of having indefinite leave to remain, is that you would have no restrictions on the kind of work you could take up. Be aware, however, that new rules came into play in 2007, meaning that anyone applying for ILR needs to be able to demonstrate a certain level of English language skills and knowledge of life in Britain.

Before applying for ILR, you should establish whether you have a good case and meet all the criteria. The process can be lengthy and expensive, so you should always seek advice from specialist immigration solicitors, such as our team at Theva Solicitors, first. Our experience and knowledge in this field will help to determine whether to proceed with your application, and should this be the case, we have five same day visa appointments with UKBA every Thursday to put forward your application. As the law and regulations continue to change, we keep abreast of updates so we always know whether your case has merit or not.
